5. LIMITATION OF LIABILITY
5.1. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE USE OF THE SITE IS AT YOUR OWN RISK AND THE ENTIRE RISK OF PROVIDING, ACCESSING, UPLOADING AND DOWNLOADING CONTENT, INCLUDING BUT NOT LIMITED TO INFRINGEMENT OF COPYRIGHT, INTELLECTUAL PROPERTY MATTERS OR DAMAGE TO EQUIPMENT OR EARNINGS IS WITH YOU.

IN ALL CASES, SANDAGER & ROCK LTD MAXIMUM LIABILITY IN RESPECT OF THE ABUSE OF ANY PART OF THE SITE OR THE CONTENT SHALL BE LIMITED TO THE FEES COLLECTED FOR THE CONTENT THAT IS THE FOCUS OF THE CLAIM. IN NO EVENT SHALL SANDAGER & ROCK LTD TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY ENGLISH POUNDS (£50.00)

You or anyone acting on your behalf agree to indemnify SampleSociety or any of its directors, employees, shareholders, partners, agents or licensees harmless of any and all claims, liabilities, losses or costs incurred by any SampleSociety party as a direct or in-direct result of a breach of these Terms of Use, including but not limited to any claim threatened or asserted against any SampleSociety Party for Illegal Content and infringements of any copyrights, trade secrets, trademarks or other intellectual property rights of any third party.

9. Governing Law & Severability
9.1. The Site is owned and operated by Sandager & Rock Limited from England and this Agreement is subject to the laws of England and the parties agree to submit to the exclusive jurisdiction of the English courts in respect of any dispute under this Agreement. The place of performance of the contract shall be England. If for any reason a competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this Agreement shall continue in full force and effect.
9.2. SampleSociety’s failure to enforce any provision of the Agreement shall not be construed as a waiver to this Agreement.

10. Governing Language
10.1. Any translation of this License is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License shall govern.
